Terms & Conditions

-These Terms & Conditions describe mutual benefits and duties of Customer, Shipper, or his/her Agent(s) who ordered transport with Shipping Experts who will forward this shipment. Shipping Experts shall ship the vehicle(s) from the Origin (pickup location) to Destination (drop off location) provided to Shipping Experts on Vehicle Relocation Order Confirmation form (VROC) and/or vehicle transport instructions and information issued by the Shipper/Broker/Agent.

-All pickup and delivery dates are approximate, unless explicitly stated, are NOT guaranteed.

-Additional fees can be applied if the vehicle is not in the condition described. (Example) inop, raised, lowered, convertible.

- The deposit is 100% refundable UNLESS the customer double booked with another Transport company or the vehicle is not in the condition described.

-An estimate delivery time is 10-12 business days excluding weekends and holidays. No delivery time/day is guaranteed they are only estimates (delays may occur). Shipping Experts is NOT responsible to transport vehicle(s) in time for any market/event and will not be responsible for any delays.

-Shipping Experts is only shipping the subjects vehicle(s) and is prohibited by U.S. Dept. of transportation (DOT) law from shipping any personal property with such vehicle(s). Shipper must remove all items from the vehicle(s) prior to transport. Shipping Experts is NOT responsible for any personal items not built into vehicle. All loose/fragile interior items must be secured or removed. The vehicle must be clean enough for inspection (condition report) prior to transport.

-The shipper and Shipping Experts driver(s) inspect the vehicle at Origin to note any MAJOR defects. Inspection report (condition of vehicle report) does NOT completely describe every defect. Minor defects as from normal use and pre-existing damages, are not Transport Related Damage. Shipper is responsible for actively and accurately describing all vehicle problems at the time of pickup regardless of time of day, weather, or lighting conditions. Shipper will document vehicle condition report prior to shipping, else waive any claim. The shipper or authorized agent(s) shall inspect the vehicle at Delivery using the same standards as at the Origin. All Transport Related Damages must be noted on this inspection at the

time of Delivery. Shipping Experts is NOT responsible for any claims except as reported at the time of Delivery. Exceptions for damages must be noted on the Bill of Lading at the time of Delivery. Claim for damage not documented on the Bill of Lading will NOT be honored, all claims noted on the Bill of Lading must be made in writing within 3(three) days of delivery with a statement of specific damages claimed. All claims must be supported by at least 3(three) estimates for repair from a certified repair shop. Should there be Transport Related Damage to your vehicle Shipping Experts will repair your vehicle

at a certified shop of their choice. All claims, subrogation, litigation or legal action must have right on venue in the state of California, County of Sacramento. The customer agrees that this is the only contract between parties governing this transport and no other agreement or contract is in effect. No claim or legal action of any kind may be initiated against Shipping Experts driver(s), agent(s) or broker(s).

-Transport Related Damage does NOT include or apply to any: Glass, Windshields, interior damage, electronics, mechanical, undercarriage, engine equipment, malfunctions, personal items left in the vehicle, antennas, cloth or vinyl tops, mufflers, exhaust systems, tail pipes, canvas coverings, freezing of any sort, leaking fluids of any sort, fumes/odors, alignment, suspension, transmission, motor mounts, drive train, wiring, cooling system, window motors, radio/stereo system, power steering, brake system, clutch system, vehicle computer system, alarm system, etc... (anything electrical or mechanical). Shipping Experts is NOT responsible for any damage to the vehicle(s) caused by any materials flying up from the roadway or out of the sky. Shipping Experts is also NOT responsible for any damage caused by any Acts of GOD. All salvage and/or damaged vehicle(s) are shipped AS IS. No auto rentals will be honored for any delays, damages, or accidents.

-If the customer makes a request that vehicle(s) needs to be strapped-down (secure) with tie downs, Shipping Experts will NOT be responsible for the damage that results to the vehicle(s) from tie downs breaking or tearing.

-The vehicle Owner/Shipper shall, in their absence, designate a person to act as their Agent at the point of pickup and/or delivery, if for any reason they are unavailable. The Owner/Shipper is responsible for preparing the vehicle(s) for transport. All loose parts, fragile or protruding accessories, low hanging spoilers, etc,. Must be removed or properly secure. Any part of a vehicle that falls out doing transport is shippers responsibility including all damages done to the Transporting Truck/Trailer and any and all other vehicle(s). If there is an alarm system on the vehicle, the shipper is responsible to disarm any alarm system installed in the vehicle. The Owner/Shipper must provide keys/remotes to an alarm system in the vehicle. If no key/remote is provided and the alarm goes off, Shipping Experts is required by U.S. DOT to silence the alarm by any means.

-Fees include: Transport charges as agreed by customer or broker/agent with Shipping Experts. The Shipping Experts driver(s) will inform the customer of an estimate time of delivery, it is customers responsibility to have the full payment ready when Shipping Experts driver(s) arrive. Should Shipping Experts driver(s) be unable to safely get to the customers door at pickup and/or delivery the customer agrees to meet the Shipping Experts driver(s) at any specified time and place, No exceptions. All payments must be in the form of : CASH, MONEY-ORDER, CASHIERS CHECK. If the Bank refuses any payment by check or credit card for any reason, a minimum of $85.00 charge will apply plus the amount owed. The customer agrees that if the payment cannot be made by CASH or CERTIFIED FUNDS, the vehicle will be stored at customers expense, and a charge of $150.00 for 2nd (second) delivery will apply. Should the customer be unable to accept delivery for any reason, any and all storage and delivery charge will apply. The customer agrees that should their vehicle(s) become inoperative during transport, a charge of $150.00 will be applied to the transport Bill and will be collected at the time of delivery. The customer agrees that if their vehicle is none operative and/or damaged and doesn't move, a charge of $150.00 will be applied to the transport Bill and will be collected at the time of delivery. Should Shipping Experts driver arrive to the point of pickup and the customer desires not to ship the vehicle for any reason, a MINIMUM CHARGE OF $400.00 IS DUE. All charges must be paid at the time of delivery NO EXCEPTIONS. Should Shipping Experts driver(s) arrive to the point of pickup and see that the vehicle is loaded with house hold goods a minimum fee $75.00 will be applied. If payment is not made at delivery for any reason, shipper agrees to pay interest at the rate of 20.00% per month on all accounts or owed balances. Refused or unclaimed vehicles will be sold as leaned, security (UCC Art. 9) property. customer agrees to pay all costs of collection. Fees must be paid in full before review or payment of any claim.

-Shipping Experts is a freight forwarder licensed by U.S. DOT whose laws and regulations govern this transaction. These Terms and Conditions form an integral part of the Bill of Lading and Contract for Carriage as such terms are defined by Title 49 U.S.C.A. as governs this transaction. Any modification to these Terms and Conditions must be in writing. Parties hereby agree to waive any and all rights to Judicial Litigation. In case of any controversy arising from or out of this transaction agrees to arbitration any and all controversies as provided by Title 9 of the U.S. Code.
